Abstract: The research focuses on the criminal conduct of arbitrary price increases in public bidding, provided for in article 96, I, of Law n. 8.666/1993. Chapter 1 begins by carrying out a dogmatic analysis of the aforementioned crime, which especially protects the integrity of the bidding process, with a special focus on the preservation of public assets. The criminalization of overpricing in public bidding is the subject of doctrinal criticism, which suggests possible incompatibility with the constitutional principle of free competition (article 170, IV, of the Federal Constitution), as well as the guarantee of the right to property. In this context, in April 2021 the New Bidding Law (14.133/2021) came into force, which, as discussed in chapter 2, brought considerable impacts in the criminal sphere. The long legislative process resulted in the geographic transmutation of bidding crimes to a separate chapter within the Penal Code and the toughening of secondary precepts, bringing with them varied procedural consequences – in line with recent criminalization movements in the area of economic criminal law. However, as discussed in chapter 3, the new wording given to article 337-L, I, of the Penal Code leads to a discussion regarding the possible abolition of the criminalization – abolitio criminis – of arbitrary price increases in public bidding processes. The focus of the criminalized conduct, due to the legislative change, became the delivery of goods or provision of services with quality or quantity different from those stipulated in the notice, generating doubt regarding the occurrence of decriminalization of overpricing or mere normative continuity due to geographic transmutation of the crime to a different section. Finally, an x-ray of the Superior Courts' jurisprudence on the issue is presented. In short, the objective of the research is to analyze the possible occurrence of decriminalization of the conduct of arbitrary price increases in bidding processes based on a recent legislative change, using bibliographical and jurisprudential research for this purpose.
