Abstract: In recent decades, indigenous peoples have faced a scenario of great setback, marked by a standstill in demarcations of their lands, especially between the years 2016 and 2023. Worsening this situation, a legal thesis known as Marco Temporal (Temporal Milestone), has put at stake the recognition of traditional indigenous occupation territories, threatening the ancestral land right guaranteed by the constitution. This topic was widely discussed at the trial of the Extraordinary Appeal, with General Repercussion (RE/RG) 1,017,365, in which the Federal Supreme Court (STF) resolved a possession dispute involving an area overlapping the Ibirama-Laklãnõ indigenous land. Through a bibliographical survey and analysis of important documents, such as the Report on identification and delimitation of traditionally occupied Laklãnõ/Xokleng land and the Extraordinary Appeal 1,017,365 filed by the National Indigenous Foundation (FUNAI), the study's main objective is an in-depth analysis of the impacts of the Marco Temporal on the territoriality of the Laklãnõ/Xokleng. The research also reflects how this legal thesis has affected the territorial rights of indigenous peoples and examines the notions of Land, Territory and Territoriality in the light of anthropological, political and legal discussions. Anchored in João Pacheco de Oliveira's conception on forms of territorialization, this dissertation adopts a critical approach, analyzing the juridical processes and the institutions involved, such as Funai, the STF and the Brazilian legislative branch.
