Abstract: The constitutional exceptions established on article 5, XI, of the Brazilian Federal Constitution about the right of the people to be secure in their houses have constantly been judicially questioned, especially in situations where entry into the home occurs without the consent of the resident when being caught red-handed. Given the lack of objective criteria for examining these situations, in March 2021 the Superior Tribunal de Justiça ruled on HC nº. 598.051/SP which minimum standards of proof were demanded for home invasion without a court order in case of suspicion of a crime being committed. The general objective of this study is to identify how the Tribunal Regional Federal da 4ª Região rules it´s cases before and after the aforementioned judgment of HC 598.051/SP regarding these evidential standards, in order to verify what was the repercussion of the judgment in the understanding of TRF4. Based on the inductive method of approach, we will start by observing the basis of the HC 598.051/SP decision to reach broader conclusions, which will be done by collecting information from the judgments made by the TRF4 on the same topic, proceeding with gathering and systematic organization of the data collected, with the purpose of preparing an analysis based on these data. The study begins with the introduction; in chapter 1 the case is contextualized from the precedents that led to the decision in HC nº. 598.051/SP and the legally relevant facts are exposed; chapter 2 presents a theoretical study on evidentiary standards, with a focus on criminal procedure; Chapter 3 reveals the results of the case study of the jurisprudence of the Tribunal Regional Federal da 4ª Região; ending with the conclusion. At the end of the study, it was verified that before the judgment of HC nº. 598.051/SP there were few cases in which the legality of the house search carried out in cases of being caught red-handed was discussed, with only 26 cases being judged debating this topic until the year of publication of the judgment of HC nº. 598.051/SP, among which the nullity of the evidence obtained with the measure was recognized in only 01 case. In the year of publication of HC nº. 598.051/SP, there was a significant increase in the number of cases judged by the TRF4 that dealt with the subject, totaling 16, more than double the previous year, with the nullity of the evidence being recognized in 4 of these cases, evidencing the significant impact of the leading case on regional court judgments.
